Concentrating on corporate bankruptcy and out-of-court restructuring matters, with extensive experience representing distressed companies, creditors and acquirers of such companies, preference defendants, and other parties. Services include:
- Formulating and implementing out-of-court restructurings.
- Filing for bankruptcy protection under Chapter 7 or 11 and developing and effectuating an exit strategy.
- Filing proofs of claim and seeking payment of administrative expenses.
- Purchasing assets (including leases).
- Enforcing contractual rights.
- Reviewing fee applications.
- Acting as local counsel and conflicts counsel.
- Defending preference actions and other bankruptcy actions.
- Addressing intellectual property issues.
- Analyzing small business issues.
Bankruptcy/restructuring representations include:
- General bankruptcy counsel to PubliCARD, Inc., a public company, in its bankruptcy case commenced on May 17, 2007 in the U.S. Bankruptcy Court for the Southern District of New York.
- Counsel to Bank of America, as a plaintiff in bankruptcy litigation.
- Counsel to a defendant in a $475,000 preference action.
